Terms and Conditions

1. Acceptance of Terms
By accessing and using PAKKA Logistics' application and website (the "Services"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
2. Eligibility
You must be at least 18 years of age to use our Services. By using PAKKA, you represent and warrant that you are at least 18 years old and possess the legal authority to enter into this agreement.
3. User Accounts
You are responsible for maintaining the confidentiality of your account information and password. You agree to accept responsibility for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
4. Service Description
PAKKA Logistics provides a platform connecting customers with delivery drivers. While we strive to provide accurate and timely service, we do not guarantee specific delivery times or outcomes. Delivery times are estimates and subject to traffic conditions, weather, and other circumstances beyond our control.
5. Driver Terms
5.1 KYC Requirements
All drivers must complete KYC (Know Your Customer) verification including submission of valid identification documents (Aadhar, PAN, Driving License) and background checks. Drivers must maintain a minimum rating of 4.0 stars.
5.2 Earnings and Payouts
Drivers earn commission on completed deliveries. Earnings are credited to the driver's digital wallet after order completion. Withdrawals can be made weekly to registered bank accounts. PAKKA retains the right to adjust commission rates with 7 days' notice.
5.3 Vehicle and Equipment
Drivers must maintain their vehicles in good condition and ensure valid insurance, registration, and pollution certificates. Drivers are responsible for their own vehicle maintenance and fuel costs.
5.4 Code of Conduct
Drivers agree to conduct themselves professionally, treat customers with respect, follow traffic rules, and comply with all applicable laws. Any violation may result in suspension or termination of account.
6. Customer Terms
6.1 Order Placement
Customers place orders through the PAKKA app or website. You confirm that the pickup and delivery addresses are accurate and that the package contents are legal and not prohibited.
6.2 Payment
Customers agree to pay the quoted delivery fee. We accept credit/debit cards, digital wallets, UPI, and cash-on-delivery. For COD orders, payment is made to the driver.
6.3 Cancellation Policy
Orders can be cancelled free of charge within 2 minutes of booking. After 2 minutes, a cancellation fee of 10% of the delivery charge applies. No refunds are provided for orders already in transit.
7. Prohibited Activities
You agree not to:
- Use PAKKA for illegal activities or to transport prohibited items
- Harass, abuse, or discriminate against other users or drivers
- Manipulate ratings, reviews, or conduct fraudulent activities
- Interfere with the operation or security of PAKKA's systems
- Share your account or permit unauthorized access
- Attempt to defraud PAKKA or other users
8. Limitation of Liability
To the fullest extent permitted by law, PAKKA shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our liability is limited to the amount you paid for the specific order in question.
9. Dispute Resolution
Any disputes arising from the use of PAKKA shall be resolved through good faith negotiation. If disputes cannot be resolved, they shall be submitted to binding arbitration or mediation as per applicable law.
10. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of India, and you irrevocably submit to the exclusive jurisdiction of the courts located in India.
